2007-1975. Disciplinary Counsel v. Broschak, Slip Opinion No. 2008-Ohio-2224.
On Certified Report by the Board of Commissioners on Grievances and Discipline, No. 06-080. Thomas J. Broschak, Attorney Registration No. 0019547, is indefinitely suspended from the practice of law in Ohio.

(May 15, 2008) The Supreme Court of Ohio today indefinitely suspended the law license of Hilliard attorney Thomas J. Broschak for neglecting the cases of nine different clients who retained him to represent them in appeals of criminal convictions. The Court also found that Broschak failed to refund his clients’ unearned legal fees, and subsequently failed to cooperate with disciplinary authorities in the investigation of his misconduct.
The Court voted 7-0 to adopt findings by the Board of Commissioners on Grievances & Discipline that Broschak violated multiple state attorney discipline rules by accepting advance legal fees of as much as $15,000 from clients seeking to appeal their convictions for crimes including aggravated murder, kidnapping, attempted rape and aggravated drug trafficking, then failing to prepare or file required pleadings or to take other necessary actions, ultimately resulting in the dismissal of eight of his clients’ appeals.
Because Broschak failed to answer the complaint filed against him by the Office of Disciplinary Counsel or appear for a hearing, the board of commissioners appointed a master commissioner and conducted default proceedings in which he was found to have committed the charged rule violations.
