00-1564. Dayton Bar Assn. v. Brunner.

The Supreme Court voted 7-0 to suspend L. Keith Brunner's law license for an indefinite period, but made the suspension retroactive to Dec. 18, 1996, the starting date of a previous suspension.

The result is that Brunner can petition the court immediately to have his license reinstated. Without the retroactivity provision, he would have had to wait until May 2, 2003.

The 1996 "interim" suspension against Brunner was issued to allow for an investigation into possible professional misconduct tied to his felony convictions for bank fraud and conspiracy to commit tax fraud. Disciplinary commissioners charged Brunner with a single conduct rule violation, recommending that he be suspended indefinitely from the practice of law but receive credit for the time served in the interim.
