The Supreme Court of Ohio will accept public comment until Nov. 18 on the annual update to the Rules of Procedure for appellate, civil, criminal and juvenile matters.
The proposed amendments were recommended to the Supreme Court by the Commission on the Rules of Practice and Procedure.
One notable change recommended by the Commission and published for comment by the Court are amendments to Civ. R. 4 through 4.6, which would require a plaintiff to make service of process rather than the clerk in civil cases. Under current rules, the clerk issues a summons for service upon each defendant listed in the caption. The amendments also make changes to the methods of service, add a limited liability company to who may be served, align out-of-state service requirements with in-state requirements and allow service by ordinary mail if certified or express mail service is refused.
Other amendments include changes to the way depositions are conducted in juvenile proceedings and clarifications on permissible methods of juror selection.
