Supreme Court Seeks Public Comment on Retired Judge Rule

The Supreme Court of Ohio will accept public comment until Nov. 4 about a rule that concerns retired judges adjudicating civil actions or proceedings.

The proposed amendment to Gov. Jud. R. VI, Section 1(C)(2) conforms the rule to the Supreme Court’s holding in Barnes v. Univ. Hosps. Of Cleveland, 119 Ohio St.3d 173, 2008-Ohio-3344.

In Barnes, the Court held that a retired judge who was never elected but served as a judge by appointment of the governor was eligible to serve as a private judge under R.C. 2701.10. The rule change adds the words “or appointed” to the definition of a “voluntarily retired judge.”
