Supreme Court Takes Comments on Amendments to Disciplinary Procedure

The Supreme Court of Ohio today released for public comment new rules dealing with employing a disqualified or suspended attorney.

Specifically, the proposed changes to Rule V. Disciplinary Procedure of the Rules for the Government of the Bar of Ohio would prohibit a disqualified or suspended attorney from direct client contact or handling client funds. In addition, a client must be notified in writing if a disqualified or suspended attorney assists another attorney on a client’s case.

Current Court rules require registration of a suspended attorney’s employment and supervision by the employing attorney. There are no rules regulating the employment of a disbarred attorney or an attorney who has resigned from the practice of law with disciplinary action pending.

Public comment on the new rules will be accepted until May 13, 2008.
