Judge Lynn C. Slaby of the Ninth District Court of Appeals served as visiting judge on the Supreme Court of Ohio today and heard oral arguments in one case. Judge Slaby also sat on the Supreme Court as a visiting judge in November 2006.
Judge Slaby was selected by Chief Justice Thomas J. Moyer to sit in place of Justice Robert R. Cupp,who recused himself from Lager v. Miller-Gonzalez (Case Nos. 2007-1760 and 2007-1762).
According to the Ohio Constitution, in the event of a recusal by a Justice, the Chief Justice of the Supreme Court can select any of the 68 sitting Ohio appellate court judges to sit temporarily on the Supreme Court.“We are pleased to have Judge Slaby join us today,” Chief Justice Moyer said. “His participation provides the parties in the case with a court of seven justices despite the recusal of Justice Cupp.”
The Lager case – out of Lucas County – involves a wrongful death action and whether the auto liability insurance policy of the parents covers their daughter who was killed in 2003 in a car accident. Sara Lager was a passenger in her vehicle, which was covered under her own separate insurance policy, at the time of the collision.
The Ninth District Court of Appeals serves Lorain, Medina, Summit and Wayne counties, and hears cases from county, municipal and common pleas courts as well as original actions in habeas corpus, mandamus, prohibition, procedendo and quo warranto. Judge Slaby was appointed to the court in 1995.
Judge Slaby serves as a senior judge on the Ninth District Court of Appeals, having participated in more than 3,000 cases and written more than 1,000 opinions in his judicial career. Before his appointment, Judge Slaby was the Summit County prosecuting attorney. He also served as assistant law director and prosecutor for the cities of Akron and Cuyahoga Falls.

I am always excited to be a part of decisions that will make new law for the citizens of Ohio.”
