Visiting Judges Moore, Farmer Hear Supreme Court Cases

Two judges from district courts throughout the state served as visiting judges on the Supreme Court of Ohio today hearing oral arguments in four cases. The judges were selected by Chief Justice Thomas J. Moyer to sit in place of Justice Alice Robie Resnick who recused herself from the four cases. Today's session took place at the Delaware County Courthouse as part of the Court's semi-annual Off-Site Court Program.

Sitting on the Court today were Judge Carla Moore of the 9th District Court of Appeals and Judge Shelia Farmer of the 5th District Court of Appeals.

Judge Moore heard oral arguments in the first and second cases. Estate of Cramer v. Auglaize Acres et al., Case No. 2005-1629, addresses the state law that confers general immunity from civil lawsuits on political subdivisions of the state, Dugan & Meyers Construction Co. v. State of Ohio Dept. of Administrative Services, Case No. 2005-1698, involves a contract dispute between the state and a construction company.

Judge Farmer heard oral arguments in the third and fourth cases. State v. Buzzard, Case No. 2005-2061, examines the constitutional right to be free from unreasonable search and seizure, and In re Estate of Holycross, Case No. 2005-2281, involves a constitutional ban against retroactive legislation.

According to the Ohio Constitution, in the event of a recusal by a Justice, the Chief Justice of the Supreme Court can select any of the 68 sitting Ohio appellate court judges to sit temporarily on the Supreme Court.

“We are pleased to have these judges join us today,” Chief Justice Moyer said. “Their participation provides the parties in the case with a court of seven justices despite the recusal of Justice Resnick.”
