Two judges from district courts throughout the state served as visiting judges on the Supreme Court of Ohio today hearing oral arguments in five cases. The judges were selected by Chief Justice Thomas J. Moyer to sit in place of Justice Alice Robie Resnick who recused herself from the five cases.
Sitting on the Court today were Judge Sean Gallagher of the 8th District Court of Appeals and Judge Diane Grendell of the 11th District Court of Appeals.
Judge Gallagher heard oral arguments in the first two cases. State v. Pelfrey, Case Nos. 2005-2075 and 2005-2211, examines a section
of Ohio's criminal sentencing statute, and State v. Sterling, Case No. 2005-2388,
considers a constitutional question of separation of powers.
Judge Grendell heard oral arguments in the final three cases. American Interstate Insurance Company v. G & H Service Center, Inc., Case No. 2006-0051,
involves an insurance lawsuit out of Shelby County, Girl Scouts-Great Trail Council v. McAndrew, Tax Commissioner, Case No. 2006-0266,
considers a provision of Ohio law granting property tax exemptions to charitable organizations, and
Akron Bar Association v. Amourgis, Case No. 2006-1189,
involves an attorney disciplinary matter.
According to the Ohio Constitution, in the event of a recusal by a Justice, the Chief Justice of the Supreme Court can select any of the 68 sitting Ohio appellate court judges to sit temporarily on the Supreme Court.
“We are pleased to have these judges join us today,” Chief Justice Moyer said. “Their participation provides the parties in the case with a court of seven justices despite the recusal of Justice Resnick.”
